3. HOW WE COLLECT INFORMATION

We collect information:

  • directly from you when you register or complete your profile;
  • when you update your account or preferences;
  • when you use SMD's search and matching functionality;
  • when you upload content;
  • when you communicate with us;
  • when you report another user; and
  • automatically through technology required to operate and secure the platform.

4. HOW WE USE YOUR INFORMATION

We may use your information to:

  • create and administer your account;
  • authenticate you and secure your account;
  • provide the SMD service;
  • display the profile information you choose to provide to other registered users;
  • enable users to discover relevant businesses and marketers;
  • provide search and filtering functionality;
  • generate AI-assisted matches and recommendations;
  • administer account and privacy preferences;

  • send marketing where we have an appropriate legal basis to do so.

5. OUR LAWFUL BASES

Depending on the processing activity, we may rely on:

Contract – where processing is necessary to provide SMD to you or take steps at your request in connection with the service.

Legitimate interests – where reasonably necessary to operate, secure, administer, improve and protect SMD and our business, provided those interests are not overridden by your rights and interests.

Consent – where you have actively agreed to particular processing, including electronic marketing where consent is the basis relied upon.

Legal obligation – where we need to process information to comply with applicable law.

Other lawful bases may apply where permitted or required by applicable data protection law.

6. ACCOUNT EMAIL AND DIRECTORY PROFILE

Your email address is required to create and administer your SMD account.

SMD separates your private account email from the general directory profile data used to provide the Directory.

Your account email is used for purposes including authentication, account administration and essential service functionality and is not displayed within your directory profile by default.

You may choose to enable “Display my email address on my profile”.

If you enable this setting, an email address may be displayed on your directory profile to other registered SMD users.

If you switch the setting off, the displayed email is removed from the directory profile.

Your private account email may continue to be retained separately as necessary to operate and administer your account.

7. DIRECTORY PROFILES

SMD operates behind a login.

Information you choose to include on your directory profile may be visible to other registered SMD users.

You should only include information in your profile that you are comfortable sharing with other members.

SMD is not intended to make member profiles publicly searchable on the open internet.

8. AI MATCHMAKING

SMD uses artificial intelligence and automated technology to assist with matching users.

The system may use information supplied in profiles and preferences to identify potentially relevant marketers, businesses or professional connections.

This may include factors such as industry, location, services, experience, requirements, budget and other profile information.

AI recommendations are designed to assist discovery.

Users remain responsible for deciding whether to contact, engage or work with another user.

An AI match does not itself enter you into a contract, hire another user or make a legally binding decision on your behalf.

9. CRM AND GOHIGHLEVEL

We use or may use GoHighLevel (“GHL”) as part of our customer relationship management and communications infrastructure.

Relevant account and contact information may be stored or processed within GHL for legitimate account administration, relationship management and communications purposes.

Being stored within our CRM does not by itself mean that you have consented to receive general promotional marketing.

Marketing preferences are managed separately.

Where SMD and GHL are integrated, relevant information may include your name, email address, business name, user type, account status, marketing preference and associated consent records.

We do not transfer your SMD password to GHL.

10. MARKETING

Where required, we ask separately whether you would like to receive marketing communications from Scottish Marketing.

Choosing not to receive marketing does not prevent you from creating or using an SMD account.

Where you have opted in, we may send information including:

  • Scottish Marketing news;
  • events;
  • opportunities;
  • products or services;
  • community updates; and
  • relevant promotional communications.

You can withdraw your marketing consent at any time using the unsubscribe facility in our marketing emails, through available marketing preferences or by contacting us.

Withdrawing marketing consent does not affect essential service or account communications.

11. SERVICE COMMUNICATIONS

We may send communications necessary to operate your SMD account, including:

  • account verification;
  • password resets;
  • security notifications;
  • important platform information;
  • material changes affecting the service;
  • responses to support requests; and
  • other essential administrative communications.

These are service communications rather than general promotional marketing.

12. SHARING YOUR INFORMATION

We may share or make personal information available to trusted service providers where reasonably necessary to operate SMD.

These may include providers of:

  • application infrastructure and hosting;
  • authentication;
  • CRM services;
  • email and communications;
  • artificial intelligence;
  • security;
  • analytics;
  • technical infrastructure; and
  • professional or technical support.

We may also disclose information where required by law, regulatory authorities, courts or law enforcement, or where reasonably necessary to establish, exercise or defend legal claims.

We do not sell your personal information.

13. BASE44

SMD is built and operated using Base44 technology.

Base44 and its underlying service providers may process information as part of providing the infrastructure, authentication, storage, application functionality, analytics and other technical services required to operate SMD.

SMD uses local browser storage for functionality including authentication and necessary application configuration.

Base44 may also provide built-in analytics relating to use of the application, such as application and session activity.

We have not independently enabled Base44 session recording at the date of this Privacy Policy.

Further information about technologies used through the application is provided in our Cookie Policy.

14. INTERNATIONAL PROCESSING

SMD is operated by a UK company but is available to users internationally.

Some of our technology providers may process or store information outside the United Kingdom.

Where personal information is transferred internationally, appropriate safeguards will be used where required by applicable data protection law.

15. DATA RETENTION

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including providing your account, maintaining appropriate records, complying with legal obligations, resolving disputes and protecting our legitimate interests.

When an account is deleted, its directory profile and access to SMD are removed.

Certain information may be retained for longer where reasonably necessary for security, fraud prevention, complaint handling, evidencing consent or acceptance, legal compliance, or establishing, exercising or defending legal claims.

16. SECURITY

We take reasonable organisational and technical measures to protect information processed through SMD.

SMD's directory profile architecture separates private account email information from general directory profile records.

However, no online platform or electronic storage system can be guaranteed to be completely secure.

Users are responsible for keeping their login credentials confidential.

17. YOUR DATA PROTECTION RIGHTS

Depending on applicable law and your circumstances, you may have rights including the right to:

  • request access to your personal information;
  • request correction of inaccurate information;
  • request deletion of your information;
  • request restriction of processing;
  • object to certain processing;
  • request transfer of certain information;
  • withdraw consent where processing relies on consent; and
  • raise concerns about how your information is being used.

These rights may be subject to legal conditions and exceptions.

To exercise a privacy right, contact:

susan@scottishmarketingsummit.com

We may need to verify your identity before fulfilling certain requests.

18. COMPLAINTS

If you have concerns about our use of your personal information, please contact us so we have an opportunity to address them.

You also have the right, where applicable, to complain to the UK Information Commissioner's Office (“ICO”) or another relevant data protection authority.

19. CHILDREN'S PRIVACY

SMD is intended only for people aged 18 or over.

We do not knowingly provide SMD accounts to children.

If we become aware that an account is being operated by someone under 18, we may restrict or remove the account and associated information as appropriate.

20. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy as SMD develops, our technology changes or applicable legal requirements change.

The current version will remain available through SMD.

Where changes materially affect how we use personal information, we will take appropriate steps to inform users.
