SMD is an online discovery and matchmaking platform designed to help businesses and marketing professionals find and connect with one another.
Although SMD has a particular focus on Scotland and the Scottish business and marketing community, users may join from anywhere in the world.
By accessing or using SMD, you agree to these Terms of Use.
You must be at least 18 years old to use SMD.
By creating an account, you confirm that:
We may refuse, restrict, suspend or remove access to SMD where we reasonably consider this appropriate, subject to applicable law.
You are responsible for maintaining the security of your account and login credentials.
You must not:
You are responsible for activity carried out through your account.
Users may provide information including, but not limited to:
You are responsible for ensuring information you provide is accurate to the best of your knowledge and for keeping your profile reasonably up to date.
SMD does not routinely verify the identity, experience, qualifications, portfolio, client history, financial standing, claims, representations or other information provided by users.
The presence of a person or business within SMD does not mean that Socially Creative Ltd has vetted, accredited, approved, recommended or endorsed them.
SMD is an account-based directory. Directory profiles are intended to be viewed by registered SMD users after login and are not intended to be publicly accessible profiles on the open internet.
Your account email address is required for account administration and authentication.
Your account email is not included in your general directory profile by default.
You may separately choose to display an email address on your directory profile by enabling the “Display my email address on my profile” setting.
If you enable this setting, you acknowledge that other registered SMD users will be able to view the displayed email address and may use it to contact you for legitimate professional purposes.
You may turn email visibility off at any time.
Displaying an email address does not constitute consent to receive bulk marketing or to be added to third-party mailing lists.
SMD may use artificial intelligence and automated technology to suggest potentially relevant businesses, marketers or professional connections.
Matches may be generated using information supplied by users, including factors such as location, industry, services, requirements, experience, budget, preferences and other profile information.
AI-generated matches and recommendations are provided as discovery tools only.
A match does not constitute:
References to a “perfect match”, match percentage, compatibility or similar terminology within SMD or its marketing describe the intended discovery experience and should not be interpreted as a guarantee of suitability or outcome.
Users remain responsible for carrying out their own due diligence before entering into any professional or commercial relationship.
SMD provides a platform for discovery and introductions.
Socially Creative Ltd is not a party to agreements entered into between SMD users.
If users choose to work together, they are responsible for agreeing their own:
Payments between users take place independently of SMD.
Socially Creative Ltd does not employ SMD users, act as their agent, engage them on another user's behalf or guarantee their work.
Users are responsible for carrying out whatever checks they consider appropriate before engaging another user.
Any contract, engagement or commercial relationship created following an introduction or discovery through SMD is between the relevant users.
SMD is not responsible for resolving private disputes concerning matters including work quality, payment, missed deadlines, contractual obligations, intellectual property or professional conduct.
We may choose to consider reports concerning behaviour on or connected with SMD where that behaviour may breach these Terms or our Community Guidelines.
Doing so does not mean Socially Creative Ltd assumes responsibility for resolving private commercial disputes.
You must use SMD professionally and lawfully.
You must not use SMD to:
Our Community Guidelines form part of these Terms and provide further information about acceptable behaviour.
SMD exists to create genuine professional connections.
Users may contact another member where there is a genuine and reasonably relevant business opportunity, enquiry, collaboration or professional reason for doing so.
However, being listed in SMD does not constitute consent to receive mass marketing.
Users must not treat SMD as a bulk prospecting database or mailing list.
Where users conduct their own direct marketing, they are independently responsible for complying with applicable privacy, data protection and electronic marketing laws.
Users may report profiles or behaviour they reasonably believe breaches these Terms or our Community Guidelines.
We may review reports and take action where we consider it appropriate.
Submitting a report does not guarantee that a profile will be removed, suspended or that any particular action will be taken.
We reserve the right to determine appropriate moderation action at our reasonable discretion, subject to applicable law.
We may restrict, suspend or terminate an account or remove content where we reasonably believe:
Serious breaches may result in immediate restriction or removal without prior warning where appropriate.
You retain ownership of intellectual property you upload or submit to SMD.
By uploading content, you confirm that you own it or have the necessary rights and permissions to use it.
You grant Socially Creative Ltd a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format and display that content as reasonably necessary to provide, operate, maintain and improve SMD.
You also grant Socially Creative Ltd permission to use content that you have chosen to display as part of your directory profile for reasonable promotional purposes relating to SMD, such as demonstrating the Directory, showcasing members or promoting the SMD community.
This does not transfer ownership of your content to Socially Creative Ltd.
We aim to keep SMD available and functioning effectively but cannot guarantee uninterrupted or error-free access.
Maintenance, technical issues, third-party services, security incidents or circumstances outside our reasonable control may occasionally affect availability.
Features may be changed, improved, added or removed as SMD develops.
SMD relies on third-party technology and service providers to operate aspects of the platform.
These may include application infrastructure, authentication, hosting, artificial intelligence, CRM, email, security and related technology services.
Their availability and performance may occasionally affect SMD.
SMD is currently available free of charge.
We may introduce optional paid subscriptions, features, services or other commercial offerings in future.
Where payment is required, the relevant price and any additional terms will be presented before a user purchases or subscribes.
We will not retrospectively charge users for previously free use without informing them.
While SMD is designed to help create valuable professional connections, we cannot guarantee that:
You are responsible for deciding whether another user is appropriate for your requirements.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
To the fullest extent permitted by applicable law, Socially Creative Ltd is not responsible for losses arising from private agreements, engagements, communications, representations or disputes between users.
We are not responsible for indirect or consequential business losses arising from reliance on another user's profile or an AI-generated recommendation where such liability can lawfully be excluded.
Users may request or initiate account deletion using the functionality provided within SMD or by contacting us at susan@scottishmarketingsummit.com.
Deleting an SMD account removes the user's directory profile and access to the service.
Certain information may be retained where reasonably necessary or legally permitted, including records required for security, fraud prevention, dispute management, legal compliance or establishing, exercising or defending legal claims.
Further information is provided in our Privacy Policy.
We may update these Terms as SMD develops or where legal, regulatory, security or operational requirements change.
Where a change is material, we may notify users through SMD or by email.
Where fresh acceptance is appropriate or legally required, we may require users to accept an updated version before continuing to use SMD.
These Terms are governed by the laws of England and Wales.
Nothing in these Terms removes any mandatory rights that you may have under applicable consumer or data protection law.
